WHAT DO YOU DO?

IF THE CREDITOR/DEBT COLLECTOR HAS NOT YET SUED YOU

You have just received a letter in the mail from a debt collection agency.  Or maybe you have just received a phone call from a debt collector about a debt you don’t think you owe.

What can you do to make them stop harassing you?  Don’t they understand that you don’t owe the debt, that they have the wrong person?  Don’t they understand that if you had the money to pay the debt, you would?

There are legal tools available to consumers being contacted by debt collectors under the Federal Debt Collection Practices Act.

IF THE CREDITOR HAS SUED YOU

You have just received a summons and complaint from the Court telling you that you are being sued on a past due debt.  Sometimes it is expected.  Sometimes it comes as a total shock.  It is always scary and disheartening.

What should you do?  What can you do?  How quickly do you need to do it?

You should immediately seek the advice from an attorney.  DO NOT PUT THIS OFF.  If you do not file a timely response, the Court may enter a default judgment against you.  (The Summons will tell you how long you have to file a timely response.)
